Applicable terms
Your use of the Services is subject to these terms, which we may update from time to time (together, this "Agreement"). The Agreement includes this document along with our Privacy Policy, Acceptable Use Policy and Refund Policy, each incorporated by reference.
1. Who may use the Services
1.1 Age. You must be at least 16 years old to use the Services. You represent that you are of legal age to form a binding contract, or that you have your parent's or legal guardian's permission and that they have agreed to this Agreement on your behalf.
1.2 Users under 18. If you are under 18, you represent that you have permission from a parent or legal guardian. Please read this Agreement together with them. If you are a parent or guardian of a user under 18, by allowing them to use the Services you accept this Agreement and are responsible for their activity, including any charges incurred.
1.3 Purchases. Users under 18 may not purchase a subscription or credits without the consent of a parent or legal guardian, who must hold the payment method used. By submitting payment you confirm you have the legal right to use that payment method.
1.4 Under 16. We do not knowingly collect personal information from anyone under 16. If you are under 16, please do not register or send us any personal information. If we learn we have collected such information, we delete it promptly. Contact team@thefutureclips.com if you believe this has happened.
1.5 Organisations. If you use the Services on behalf of a company, you confirm you have authority to bind that company to this Agreement. You may not share your credentials outside your organisation, and you are responsible for all activity under them.
2. Your account
You must register an account and provide accurate, complete and current information. You may not use a name you have no right to use, or another person's name with intent to impersonate. You may not transfer your account without our written permission.
You are responsible for the security of your account and password, and for all activity under it. We may access your account to troubleshoot, administer, or for diagnostic, security and corrective purposes.
Sharing accounts, or operating multiple accounts to circumvent plan limits, is not permitted.
3. The Services
3.1 What we do. the futureclips is a content creation platform for social media creators. You provide a topic, style and character selection, and the platform produces a sequence of images ("Slides") and accompanying text ready to publish. To produce this content we use third-party service providers. We do not develop or operate the underlying models ourselves.
3.2 Slides, allowances and credits.
- One Slide equals one generated image.
- Each subscription plan includes a monthly Slide allowance, described on our pricing page.
- Monthly allowance does not roll over and expires at the end of each billing period.
- Additional Slides may be purchased as credit packs. Purchased credits do not expire.
- Your monthly allowance is used before any purchased credits.
- Editing text on an existing Slide, or re-exporting, does not use Slides.
- Where you set a Slide range, we generate a count within that range based on the topic, and charge only for Slides actually produced.
- If generation fails due to a technical fault on our side, the Slides return to your balance automatically.
3.3 Changes to the Services. We are continually improving the Services and may add, modify or remove features, or discontinue the Services in whole or in part, to improve performance or security, comply with law, or prevent abuse. We will try to give notice of material changes that adversely affect you, though this is not always practical.
3.4 Availability. We aim for continuous availability but do not guarantee that the Services will be uninterrupted or error-free.
4. Content and ownership
4.1 What you own. Subject to your compliance with this Agreement, you own the images and text you create through the Services ("Output"). We claim no ownership of your Output.
You are solely responsible for your Output and how you use it, including making sure it complies with the rules of any platform you publish it on and with all laws that apply to you.
4.2 What we own. We retain all rights in the Services, including our software, character models, prompt systems, templates, trade names, trademarks and logos. Using the Services gives you no ownership of any part of them.
4.3 Licence you grant us. You grant us a limited licence to store, process, reproduce and modify your inputs and Output only as needed to operate and provide the Services to you and to detect and prevent abuse. This licence ends when you delete the content or your account, subject to any retention required by law.
We do not use your inputs or Output to train artificial intelligence models.
4.4 No guarantee of results. The Services help you create content. We make no representation or warranty about views, engagement, follower growth, revenue, monetisation or performance on any platform. Any figures shown in our marketing are illustrative and are not a promise of results.
5. Acceptable use
Your use of the Services is subject to our Acceptable Use Policy, incorporated by reference. Violation is grounds for immediate suspension or termination without refund.
We may use automated and manual systems to review inputs and Output to detect violations, and may use IP addresses and other indicators to identify fraudulent or suspicious activity. Where we detect it, we may cancel credits, terminate accounts, or prevent associated identifiers from registering new accounts.
6. Fees and payment
6.1 Paid plans. Certain Services require payment. Current plans and prices are on our pricing page. Payment terms shown at signup form part of this Agreement.
6.2 Payment processors. We use third-party payment processors, which may act as merchant of record, to bill you. Their terms and privacy policies apply in addition to this Agreement. We do not receive or store full payment card details. We are not responsible for errors or omissions of the payment processors.
6.3 Recurring billing. By choosing a recurring plan you acknowledge that the Services have a recurring payment feature and accept responsibility for all recurring charges before cancellation. We may submit periodic charges without further authorisation until you cancel. Cancellation does not affect charges already submitted before we could reasonably act on it.
6.4 Auto-renewal and cancellation. Unless cancelled, your plan renews automatically for successive periods of the same length at the then-current rate. You can cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period, and you keep access until then.
6.5 Price changes. We may change our fees. We will tell you in advance so you can cancel before the change takes effect. Changes apply from the end of your then-current billing cycle. Continuing to use the Services after a change means you accept the new price.
6.6 Billing information. You must keep your billing information current, complete and accurate. If you do not, we may continue to charge for the Services unless you have cancelled.
6.7 Taxes. Where a merchant of record is used, applicable sales tax, VAT or GST is collected and remitted by that provider. You are responsible for any other taxes arising from your use of the Services.
6.8 No refunds. All sales are final. Subscriptions, renewals, annual plans and Slide packs are non-refundable. Cancelling stops the next charge and does not reverse charges already made; you keep access until the end of the period you have paid for. Our Refund Policy sets out the only exceptions: billing errors, unauthorised charges, and the automatic return of Slides reserved by a generation that failed through a fault of ours.
6.9 Immediate access to digital content. The Services are digital content supplied immediately. By completing a purchase you ask us to make them available to you at once and, where you would otherwise have a statutory right to withdraw from the purchase within a cooling-off period, you agree that you lose that right once we do. Nothing in this Agreement removes a right you have by law and cannot give up.
6.10 Free trials. We do not offer a free trial. The demo is available without payment details so you can see what the Services produce before you buy. Where any trial or promotional offer is made, it must be used within the stated period, and we may modify or withdraw it at any time.
7. Suspension and termination
By you. You may stop using the Services at any time and delete your account from your account settings. You can download a copy of your Output first.
By us. We may suspend or terminate your access at our discretion, including for breach of this Agreement.
Effect. Termination may result in deletion of Output associated with your account. We will try to give advance notice so you can retrieve your content, unless that would be impractical, unlawful, or harmful to the rights, safety or property of others or of us.
Provisions that by their nature should survive termination will do so, including payment obligations, indemnities, liability limits, ownership provisions and dispute resolution terms.
8. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
We make no representations or warranties concerning the accuracy, legality or suitability of any Output produced through the Services.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY SHALL WE BE LIABLE TO YOU OR ANY OTHER PERSON FOR:
(a) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, LOSS OF GOODWILL OR LOSS OF ANTICIPATED SAVINGS;
(b) ANY SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY;
(c) ANY AMOUNT IN THE AGGREGATE EXCEEDING THE GREATER OF (I) ONE HUNDRED US DOLLARS ($100) OR (II) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM; OR
(d) ANY MATTER BEYOND OUR REASONABLE CONTROL.
Some jurisdictions do not allow certain exclusions or limitations, so parts of the above may not apply to you.
10. Indemnity
You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from or related to your use of the Services, including actions taken by any third party using your account; your Output; and your violation of this Agreement or of applicable law.
11. Intellectual property complaints
We respect intellectual property and publicity rights. If you believe content produced or distributed through the Services infringes your copyright, trademark or right of publicity, email team@thefutureclips.com with:
- A physical or electronic signature of a person authorised to act for the rights owner;
- Identification of the work or right allegedly infringed;
- Identification of the material claimed to be infringing, with enough detail for us to locate it;
- Your contact details;
- A statement that you believe in good faith the use is not authorised by the owner, its agent, or the law;
- A statement, under penalty of perjury, that the information is accurate and that you are authorised to act for the owner.
On receiving a valid notice we may remove or disable access to the material, notify the account holder, and terminate access for repeat infringers.
12. Dispute resolution
Talk to us first. Most problems can be resolved quickly. Before starting any formal proceeding, you agree to contact us at team@thefutureclips.com and give us 30 days to resolve the matter in good faith. This step is a precondition to bringing any claim.
Informal resolution. If we cannot resolve the matter within 30 days, either party may pursue a claim. Both parties agree to attempt mediation before litigation where practical.
Governing law. This Agreement is governed by the laws applicable at the location of our principal place of business, without regard to conflict of law provisions. Where mandatory consumer protection law in your country of residence gives you rights that cannot be waived by agreement, those rights are unaffected.
Individual claims only. To the extent permitted by law, claims must be brought individually and not as a plaintiff or class member in any purported class or representative proceeding.
Time limit. Any claim arising out of or relating to the Services must be brought within one year after it arises, or it is permanently barred.
13. General
Changes. We may change this Agreement. If we do, we will post a notice on our website, email you, or notify you by other means. If you do not agree with the new terms, stop using the Services. Continued use after changes take effect means you accept them.
Assignment. You may not assign or transfer this Agreement without our written consent. We may assign it without consent.
Severability. If any term is unenforceable, the rest remain in effect.
No waiver. If we do not enforce a right, we do not waive it.
Interpretation. "Include" and "including" mean "including but not limited to".
Entire agreement. This Agreement is the complete and exclusive statement of the understanding between you and us, and supersedes all prior agreements on its subject matter.
Relationship. Nothing here creates an employment, agency, partnership or joint venture relationship.
